Peak City Sitters Parent Contract

This Agreement is made effective on __________ between Peak City Sitters, LLC (“PCS”) and __________ (“Client”). Please review each section of this Agreement and sign below before requesting a Sitter through PCS. Your signature below serves as: (a) your confirmation that you understand and agree to adhere to the policies set forth below and (b) your acknowledgment that your agreement to the terms contained herein is material to PCS and serves as the inducement for PCS to provide you with a Sitter upon request.
For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged by the parties, PCS and Client agree as follows:

1.	Peak City Sitters (PCS) will use good faith efforts to provide suitable childcare providers (babysitters and nannies) for clients, whether on an on-call placement basis or a long-term and/or recurring placement basis.
2.	Annual Registration Fee = $45 per family (renewed each year)
3.	Rates paid to Peak City Sitters:
    
    The client agrees to pay Peak City Sitters the below placement fees per sitter request for Date night, Occasional needs, Temporary needs, and Backup Childcare:
    o	$18 placement fee with 24 or more hours of notice, 
    o	$20 placement fee with less than 24 hours notice,
    o	$22 placement fee with 12 hours or less.

Please note: The applicable Placement Fee is charged when a sitter is scheduled, even if the client cancels and does not use the babysitter.
4.	Babysitter Rate: Peak City Sitters offers a range of sitter placements, including date night, occasional, and backup childcare. The client acknowledges and accepts the responsibility to compensate the referred babysitter directly at the specified sitter rates:
    o	$18.00 per hour for 1-2 Children,
    o	$20.00 per hour for 3 Children,
    o	$22.00 per hour for 4 Children,
    o	$24.00 per hour for 5 Children.
Please note: In cases where the duration of service is 2 hours or less, the babysitter will receive a flat rate of $40 for 1 child and $45 for 2+ children.
5.	Temporary Babysitter Rate: Peak City Sitters offers temporary recurring care for families who need a recurring sitter consistently for one to two months at a time. The client acknowledges and accepts the responsibility to compensate the referred sitter directly at the specified sitter rates below:
    o	$22 - $24 per hour for caring for 1-2 Children,
    o	$26 - $28 per hour for 3-4 Children,
    o	A flat rate of $50 for two hours or less.
    6.	Early Return Policy: Should the client return home more than one hour before the scheduled end time, it is expected that the sitter be compensated up to one hour before the initial end time.
7.	Permanent Placement Search Fee: If the Client hires Peak City Sitters to find a nanny for a long-term or short-term placement, the client will pay PCS a non-refundable search fee of $50.00 per nanny search.
8.	Nanny Placement Fees Paid to Peak City Sitters: The client agrees to pay Peak City Sitters the below placement fees for Long-Term and Short-Term Placements according to the rates listed below: Long-Term Placement Fees
    o	$80 per month for 2 days per week, 
    o	$90 per month for 3 days per week, 
    o	$108 per month for 4 days per week, 
    o	$135 per month for 5 days per week. 
Or Short-Term Placement Fee Per Sitter/Nanny Request: 
    o	$18 placement fee with 24 hours or more notice, 
    o	$20 placement fee with less than 24 hours notice, 
    o	$22 placement fee with 12 hours notice
9.	Nanny Rates:
Peak City Sitters offers a range of nanny placements, including long-term, short-term, and temporary arrangements. The client acknowledges and accepts the responsibility to compensate the referred nanny directly at the specified nanny rates below:
    o	$22 - $24 per hour for caring for 1-2 Children, 
    o	$24 - $26 per hour for 3-4 Children, 
    o	Flat rate of $50 for 2 hours or less.

Please Note: These rates include services such as light housework, laundry, and light meal preparation. It's important to note that the nanny rate may be adjusted to accommodate increasing needs and expectations.

Holiday Babysitting Rates: Families seeking childcare services for the following holidays: Easter Day, 4th of July, Thanksgiving, Christmas Eve, Christmas Day, New Year's Eve, and New Year's Day, are expected to compensate the babysitter at the following rates:
    o	$20 per hour for 1-2 Children,
    o	$22 per hour for 3 Children,
    o	$24 per hour for 4 Children, $26 per hour for 5 Children.
10.	Sharing a Babysitter: Clients seeking to engage Peak City Sitters to care for children from multiple households within a single residence are permitted to do so, provided that all households are active members of Peak City Sitters.
11.	No Contacting Sitters: Clients must communicate with Peak City Sitters every time they require a sitter. Clients are not permitted to directly reach out to any Peak City Sitter to arrange future babysitting engagements, regardless of duration or frequency. It is essential to understand that if a client engages a sitter referred by Peak City Sitters outside of the Peak City Sitters placement process, a $500 referral fee will be charged to the client within five business days upon confirmation of such babysitting activity occurring independent of Peak City Sitters.
12.	Waiver and Release of PCS: Client understands and agrees that PCS is only providing a referral service and is not responsible or liable for the actions of any sitters or nannies. By signing this agreement, Client, on their own behalf and on behalf of any minor child receiving babysitter or nanny care, waives and releases PCS and its managers and members from legal claims, liabilities, damages, costs and expenses (which are collectively referred to in this agreement as “claims”) that relate in any way to a sitter or nanny referred by PCS or the services provided by that sitter or nanny. This release includes claims based on any accident, property damage, personal injury (including death), illness, disability, emotional distress, or other harm that may occur during an engagement. Client also acknowledges that PCS does not carry automobile insurance for non employee sitters or nannies and does not verify the insurance coverage limits of any non employee sitters or nannies.
13.	Indemnity: If any claim is made relating to a babysitting or nanny engagement that Client arranged through PCS, including claims made by or brought on behalf of a minor receiving care, Client agrees to indemnify and hold harmless PCS, including its managers and members, from any losses they may incur. This obligation applies even if PCS is alleged to have been partly at fault, although it does not apply in cases of gross negligence or willful misconduct by PCS.
14.	Liability Limitation: If something goes wrong, Client agrees that PCS will not be responsible for any special, exemplary, punitive, or consequential damages related to this Agreement or the services provided by a sitter or nanny. Any liability PCS may have will be limited to the total amount paid or owed by Client for its services. A claim related to this Agreement must be brought within one year of the cause of action.
15.	Sick Child Policy: Peak City Sitters does not offer childcare services for children exhibiting symptoms such as vomiting, diarrhea, fever, or any contagious illness including, but not limited to, flu, Hand, Foot and Mouth Disease, COVID, or Strep Throat. In the event of a fever or contagious illness, children must have either completed a course of antibiotics or remain symptom-free for a minimum of 24 hours before Peak City Sitters can provide a sitter. Clients must inform Peak City Sitters in advance if the requested sitter will be caring for a child in recovery from an illness. Please note that Peak City Sitters cannot administer medication unless it is for emergency purposes.
16.	Cancellation of Services: Placement Fees will be charged any time a sitter is found or confirmed through PCS, even if the client cancels the sitter’s engagement. In addition, if a client cancels a sitter engagement less than 5 hours before the beginning of the scheduled sitting engagement, the Client agrees to pay the sitter a $40.00 cancellation fee.
17.	Disclosure of Information: The client acknowledges and agrees that all information disclosed or provided to Peak City Sitters during the application process is not considered confidential. The client further understands that information provided to Peak City Sitters will be shared with the selected sitter to effectively match the client with a sitter best suited for the engagement.
18.	Non-Competition/Non-Solicitation Agreement: The client agrees to not directly or indirectly compete with the business of Peak City Sitters or solicit or encourage its sitters or nannies to cease their association with Peak City Sitters while a client of Peak City Sitters and for a period of two years following termination of this agreement. The term "compete" means to own, manage, operate, or consult, directly or indirectly, a business substantially like or competitive with Peak City Sitters within 30 miles of PCS’ principal place of business located at 2575 Spurwood Court, Apex, North Carolina.
19.	Payment of Services: Any Client’s balance that is 60 or more days past due will be turned over to a third-party account collections agency.
20.	Miscellaneous: Client understands that the waivers, releases, and similar terms in this Agreement are intended to be as broad and enforceable as permitted under North Carolina law. Client understands and agrees that PCS is relying on these terms and that they represent a fair way for the parties to allocate risk between themselves. If any part of this Agreement is found to be void or unenforceable, the remaining parts remain in full force and effect.
21.	Entire Agreement: The Agreement constitutes the entire agreement between the Client and Peak City Sitters. Any disputes hereunder are to be resolved through good faith mediation or, failing that, exclusively within the state courts of Wake County, North Carolina. If Peak City Sitters prevails in any litigation, then the client agrees to reimburse Peak City Sitters for its costs and attorneys’ fees.
